Videri Limited Manufacturer's Warranty Statement


Warranty Period: Videri V Series

The Limited Warranty for the Videri VSeries is one year from the date of purchase.

Warranty Period: Videri Spark Series

The Limited Warranty for the Videri Spark Series is three years from the date of purchase.

Terms and Conditions

By using your Videri product, you are agreeing to be bound by the terms of the Limited Warranty as set out herein. Do not use your product until you have read the terms of the warranty. If you do not agree to the terms of the Warranty, do not use the product and return it to your dealer or place of purchase. To the extent permitted by law, this Warranty and the remedies set forth are exclusive and in lieu of all other warranties, remedies, and conditions, whether oral, written, statutory, express or implied. Videri and Westan disclaim all statutory and implied warranties, including, without limitation, warranties of merchantability and fitness for a particular purpose, and warranties against hidden or latent defects, to the extent permitted by law. Insofar as such warranties cannot be disclaimed, Videri and Westan limit the duration and remedies of such warranties to the duration of this express warranty and, at Videri and Westan's option, the repair or replacement services described herein.

Your Videri hardware, contained in the original packaging, is covered against defects in materials and workmanship when used normally in accordance with Videri's published guidelines for up to three years from the date of delivery. Videri's published guidelines include but are not limited to information contained in technical specifications, user manuals and service communications. Only items purchased directly from Westan are eligible for replacement. Items must not be modified or altered in any way in order to be eligible for replacement. For all returns, Westan must receive the item before the replacement unit is shipped out.

Our warranty does not apply to products that are not Videri-branded, even if packaged or sold with Videri products. Non-Videri branded products may have the benefit of a manufacturer's warranty provided by the product manufacturer or Westan. Please see your product box and/or literature for details. Software distributed by Videri, with or without the Videri brand (including, but not limited, to system software) is not covered by this warranty. Westan does not warranty that the operation of the Videri product will be uninterrupted or error-free. Videri is not responsible for damage arising from failure to follow instructions relating to the Videri product's use.

This warranty does not apply:
  1. To protective coatings that are designed to diminish over time, or batteries, unless failure has occurred due to a defect in materials or workmanship;
  2. To cosmetic damage, including but not limited to scratches, dents and broken plastic on ports unless failure has occurred due to a defect in materials or workmanship;
  3. To damage caused by use with a third-party component or product that does not meet the Videri product's specifications;
  4. To damage caused by accident, abuse, misuse, fire, liquid contact, earthquake or other external cause;
  5. To damage caused by operating the Videri product outside Vider's published guidelines;
  6. To damage caused by service (including upgrades and expansions) performed by anyone who is not a representative of Videri or an authorised Videri service provider;
  7. To a Videri product that has been modified to alter functionality or capability without the written permission of Videri;
  8. To defects caused by normal wear and tear or otherwise due to the normal aging of the Videri product;
  9. if any serial number has been removed or defaced from the Videri product; or
  10. if Westan receives information from relevant public authorities that the product has been stolen or if you are unable to deactivate passcode-enabled or other security measures designed to prevent unauthorised access to the Videri product, and you cannot prove in any way that you are the authorised user of the product (e.g. by presenting proof of purchase).
Before receiving warranty service, Westan or its agents may require that you furnish proof of purchase details, respond to questions designed to assist with diagnosing potential issues and follow Westan's procedures for obtaining warranty service.

Before submitting your Videri product for warranty service, you should maintain a separate backup copy of the contents of its storage media, remove all personal information that you want to protect and disable all security passwords.

Please note: during warranty service, it is possible that the contents of the Videri product's storage media will be lost, replaced or reformatted. In such an event, Westan and its agents are not responsible for any loss of software programs, data or other information contained on the storage media or any other part of the Videri product serviced.

Following warranty service, a replacement product will be returned to you configured as when originally purchased, subject to applicable updates. Westan may install system software updates as part of warranty service that will prevent the Videri product from reverting to an earlier version of the system software. Third party applications may not be compatible or work with the Videri product as a result of the system software update. You will be responsible for reinstalling all other software programs, data and information. Installation, recovery, and/or reinstallation of other software programs, data and information are not covered under this warranty.

No Videri reseller, agent or employee is authorised to make any modification, extension or addition to this warranty. If any term is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired.

Limitation of Liability

Except as provided in this Warranty and to the maximum extent permitted by law, Westan is not responsible for direct, indirect, special, incidental or consequential damages resulting from any breach of Warranty or condition, or under any other legal theory, including but not limited to:
  1. Loss of use
  2. Loss of revenue
  3. Loss of actual or anticipated profits (including loss of profits on contracts)
  4. Loss of the use of money
  5. Loss of anticipated savings
  6. Loss of business
  7. Loss of opportunity
  8. Loss of goodwill
  9. Loss of reputation
  10. Loss of, damage to, compromise or corruption of data
  11. Or any other direct or indirect or consequential loss or damage howsoever caused, including the replacement of equipment and property, any costs of recovering, programming or reproducing any program or data stored in or used with the Videri product, or any failure to maintain the confidentiality of information stored in the Videri product.
The foregoing limitation shall not apply to death or personal injury claims, or any statutory liability for intentional and gross negligent acts and/or omissions. Westan disclaims any representation that it will be able to repair any Videri product under this Warranty or replace the Videri product without risk to or loss of information stored on the Videri product.
