Limited Warranty for Philips Professional Television Products

Terms

  1. This Warranty is provided by Westan Australia Pty Ltd for Philips Professional Television products purchased within Australia. It is non-transferable and is provided only to purchasers of these products or the original end users of our Products. 
  2. This Warranty does not cover purchases of our Products from a Reseller by a party who is not intending to be the end user of our Product. The warranty and support for that product must be initiated by the Reseller on that party's behalf.
  3. This Warranty does not cover the Product purchased in an auction or on-sold by any seller other than a Westan-authorised Supplier of Philips Professional Television products.
  4. Our Products come with guarantees that cannot be excluded under Australian Consumer Law. You are entitled to a replacement or a refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the Goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. What constitutes a major failure is set out in Australian Consumer Law.
  5. Warranty periods are set out in Table 1 (below) of this Warranty.
  6. If during the Warranty period, starting from your date of purchase from us or from a Westan-authorised reseller, the goods prove defective by reason of improper workmanship or materials and none of your statutory rights or remedies apply, we will repair or replace the defective Products at our cost.
  7. We do not have to repair or replace the Products under this Warranty if the Products have been misused or damaged.
  8. We may decide to substitute the Products with similar alternative products of our choosing. All such decisions are at our absolute discretion.
  9. All such repaired, replaced or substituted Products continue to receive the benefit of this Warranty for the time remaining on the original Warranty period.
  10. To the extent permitted by law, this Warranty is limited to repair, replacement or substitution only. As far as the law permits, we will not be liable for any loss or damage caused to property or persons arising from any cause whatsoever.
  11. In the case of Warranty service with the valid Warranty period, you must: a) lodge your Warranty Claim at Westan's online Support Help Centre (www.support.westan.com.au) within the valid Warranty period; and b) supply your contact details, the product model and serial number, an accurate description of the defect, and proof of purchase. We may in some instances require photo and/or video evidence of the fault.
  12. The Westan Support team will contact you to make arrangements for on-site service.
  13. Products presented for repair may be replaced by refurbished products of the same type rather than being repaired. Refurbished parts may be used to repair the Products. Replacement of the product or a part does not extend or restart the Warranty period.
  14. The Products will be at the the owner's risk while in transit unless transported by us or unless we have given written agreement to accept risk and liability for the Product during transport that has not been arranged by us. We will bear the expense of transport only where transported by us or where we have given written agreement to accept other expenses.
  15. If the Product presented for repair is capable of retaining user-generated data, you are advised that repair of the product may result in loss of the data.
  16. We may seek reimbursement of any costs incurred if the product is found to be in good working order. Where repairs are performed on a Product under Warranty where no fault can be found, or where the item is deemed by us to be not faulty under this Warranty, or where the repair or fault is not covered under warranty, you may also be charged a No Fault Found fee.
  17. Any repairs or services required that are outside of this Warranty or where the fault is not covered under this Warranty, such as incorrect install or setup, can be carried out at your request. You will be charged directly for the cost for these repairs or services.
  18. If the Product is positioned on a ceiling or wall-mounted, or was installed using aftermarket mounts or stands, we may charge you an additional amount relating to the removal and/or re-installation of the Product.

General Exclusions and Limitations

This warranty will not apply:
  1. If the Product has not been installed, operated, maintained or used in accordance with the manufacturer's instructions or specifications provided with the Product;
  2. If the Product serial number has been altered or removed from the Product;
  3. To damage, malfunction or failure resulting from alterations, accident, misuse, abuse, fire, liquid, spillage, misadjustment of customer controls, use on an incorrect voltage, power surges and dips, thunderstorm activity, acts of God, voltage supply problems, tampering or unauthorised repairs by any persons, use of defective or incompatible accessories, the operation of a computer virus of any kind, exposure to abnormally corrosive conditions or entry by any insert, vermin or foreign object in the product;
  4. To damage arising during transportation, installation or while moving the product, or to any transportation costs of the product or any parts thereof to and from the owner, unless otherwise specified in these Warranty terms;
  5. To any third-party software or hardware not contained in the product as originally configured by the manufacturer;
  6. To any failure, to the extent that the failure is not a failure of the product to perform in accordance with its specifications; or
  7. To the normal incidence of off-coloured or dark pixels in LCD screens as described in the User Manual for the Product.
We will not be liable for any loss, damage or alterations to: (1) third-party hardware or software; or (2) programs, data or information stored on any media or any part of the product, no matter how occurring; or (3) for any loss or damage arising from loss of use, loss of profits or revenue, or for any resulting indirect or consequential loss or damage.
